Agreement scope
These Terms of Service govern your access to and use of Cavrino, including the Cavrino website, market pages, card pages, APIs, summaries, commentary, charts, alerts, and related content or features we make available (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
Use and restrictions
1. Informational service only
Cavrino provides pricing estimates, market signals, catalog data, historical context, and commentary about trading cards and other collectibles. The Service is for general informational use only. It is not financial, investment, legal, tax, accounting, brokerage, authentication, grading, or appraisal advice, and it is not a recommendation to buy, sell, hold, list, or value any item in any particular way.
2. Eligibility and acceptable use
You may use the Service only in compliance with applicable law. You may not use the Service to violate any law, infringe another party’s rights, interfere with the Service, test or bypass security controls, overload our infrastructure, or use the Service in a way that harms Cavrino, its operators, users, data providers, or business partners.
3. Restrictions on scraping, copying, and reuse
Unless we expressly permit it in writing, you may not scrape, crawl, systematically extract, mirror, republish, resell, sublicense, train models on, or build competing datasets or services from the Service or its content. You also may not use bots, spiders, data-mining tools, automated collection scripts, or similar methods to access or copy the Service at scale.
4. Intellectual property
The Service, including its text, layout, branding, software, graphics, market summaries, commentary, scoring methods, and other content, is owned by Cavrino or its licensors and is protected by applicable intellectual property laws. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for your personal or internal business use in accordance with these Terms. No ownership rights are transferred to you.
Data, reliability, and responsibility
5. Third-party data and links
The Service may rely on third-party data sources, derived estimates, cached market references, historical datasets, marketplace data, and external links. Those sources may change, fail, rate-limit, become unavailable, contain errors, or impose their own terms. Cavrino does not control and is not responsible for third-party sites, products, services, content, or policies.
6. Data quality and market limitations
Collectibles markets are fragmented, condition-sensitive, and often illiquid. Data shown by Cavrino may be delayed, stale, incomplete, inferred, misclassified, normalized imperfectly, or unavailable. Market depth, liquidity, confidence labels, profitability estimates, movers, hot-card rankings, and other signals are heuristics, not guarantees of executable market outcomes.
7. No warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Cavrino disclaims all warranties, whether express, implied, or statutory, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, and security. We do not warrant that the Service will be uninterrupted, error-free, current, or free of harmful components.
8. Your decisions and responsibility
You are solely responsible for your decisions, purchases, listings, offers, trades, inventory management, pricing, compliance, tax reporting, and any reliance you place on the Service. You should independently verify important facts, including card identity, condition, authenticity, legality, venue rules, and current market conditions before acting.
Liability and operations
9. Limitation of liability
To the fullest extent permitted by law, Cavrino and its operators, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or expected savings arising out of or related to the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100) or the amount you paid us for the specific Service giving rise to the claim in the twelve months before the claim, whichever is greater.
10. Indemnity
You agree to indemnify and hold harmless Cavrino and its operators, affiliates, licensors, and service providers from claims, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Service, your violation of these Terms, your infringement of another party’s rights, or your content, actions, or transactions connected to the Service.
11. Changes, suspension, and termination
We may update these Terms from time to time by posting the revised version on this page. We may also modify, suspend, restrict, or discontinue all or part of the Service at any time, with or without notice. We may suspend or terminate access if we believe you have violated these Terms, created risk for the Service, or used the Service in a prohibited manner.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent a dispute is permitted to proceed in court, you agree that the state or federal courts located in California will be the exclusive venue, except where applicable law requires otherwise.
13. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. These Terms, together with any policies or notices clearly incorporated by reference, form the entire agreement between you and Cavrino regarding the Service.
